Rouda Feder Tietjen & McGuinn Recently Settled Two Significant Cases

Our team of San Francisco personal injury attorneys at Rouda Feder Tietjen & McGuinn have recently settled two cases, each in excess of $1,000,000, for two different premises liability case clients.

Defendant Encourages Unsafe Behavior of Patrons

In the first case, our client was unloading cardboard at a facility when a large concrete block rolled onto his leg, crushing his leg and trapping him in place for several minutes. Due to the severity of his injuries, our client required an emergency amputation of his leg below the knee. The defendant facility actually encouraged customers to use the loose concrete block when unloading cardboard. We successfully argued that the facility was negligent for allowing patrons and our client to use the loose concrete block, which posed a clear and obvious hazard. After the lawsuit was filed, the facility prohibited the use of the concrete block and ultimately paid our client a $1.4 million settlement. Even though our client suffered permanently-disabling injuries, he will now be able to receive the medical treatment necessary for his ongoing care.

Improperly-Licensed Contractor Causes Worker Injury

In the second premises liability case, our client was injured while he worked for a contractor that trimmed and removed trees from properties. Unbeknownst to our client, his employer was unlicensed to perform tree trimming and removal in the state of California. On the day of his injury, our client was instructed by the contractor to pick up wood cuttings and move them into a truck. While our client was following his instructions, the contractor-employer dropped a wood cutting atop our client’s head, causing traumatic brain injuries that required multiple surgeries and many months of hospitalization. The $1.5 million settlement represents the homeowner’s insurance policy limits, as California law requires homeowners to hire licensed contractors for the work to be performed.
