The FDA has sent warnings to eight California surgery centers and an affiliated marketing firm about allegedly misleading ads promoting Lap-Band surgery. The marketing firm, 1-800-Get-Thin, has recently inundated the California market with billboard ads, bus signs and advertising inserts. The ads feature images of trim, smiling individuals who claim to have lost weight through the Lap- Band procedure. According to the FDA, these ads do little to inform consumers about the dangers and side-effects of the procedure. The agency points out that in the current ads, the warnings are written so small as to make them unreadable. Already, at least five individuals have died after undergoing the procedure at one of the eight surgery centers targeted by the FDA. The agency has said that if the ads are not changed, the FDA may go forward with product seizure and civil penalties.
