Tracy Morgan filed a lawsuit against Walmart over the fatal crash involving his limousine bus and a Walmart tractor-trailer on June 7. The collision killed Morgan’s mentor James McNair and sent Morgan to the hospital with critical injuries, including a broken nose, broken ribs, and a broken leg.
The suit was filed in the U.S. District Court in New Jersey and blames Morgan’s injuries on the negligence of Walmart’s truck driver, Kevin Roper. Investigations revealed that the Walmart truck was traveling 20 miles over the speed limit when it rear-ended Morgan’s limousine bus. Additionally, the suit contends that the driver was either near or past his drive time limit.
Kevin Roper was criminally charged with vehicular homicide and assault by auto and pleaded not guilty last month.
