The Daily Journal published an op-ed by Partner Loren Schwartz titled, “Cracking Down on Jackpot Justice: Reforming Personal Injury Advertising.”

In the piece, Loren discusses a growing trend in personal injury attorney advertising that misrepresents the legal process. From flashy images of money raining from the sky to online “settlement calculators,” these marketing tactics can create unrealistic expectations for potential clients and undermine the seriousness of the civil justice system.

With nearly 20 years of experience representing personal injury clients, Loren emphasizes that every case is unique. What may appear to be a simple slip-and-fall can have dramatically different consequences for different individuals. Misleading advertising not only distorts public perception but also creates challenges for attorneys trying to guide clients through the legal process and increases skepticism towards personal injury attorneys and their clients.

Loren also highlights a new law in California which aims to curb deceptive attorney advertising while respecting constitutional protections for commercial speech. The bill would empower consumers and help ensure that attorney marketing reflects the reality of the civil justice process, rather than promising a guaranteed “jackpot.”

Loren closes the piece, remarking, “Attorneys who try to sell personal injury lawsuits as a guaranteed jackpot undermine the critical work of personal injury attorneys and diminish the credibility of the civil justice system.”
