Partner Loren Schwartz recently presented at the San Francisco Trial Lawyers Association (SFTLA) Ski & CLE Seminar, where he led a session titled “Beyond the Incision: Evaluating and Prosecuting Post-Operative Infection Cases.”

During the session, Loren provided an in-depth look at the science behind post-surgical infections, highlighting how and why these complications occur, as well as the critical points at which medical providers may fall short in preventing or properly treating them. He also offered practical guidance for attorneys on building strong, evidence-based cases on behalf of patients who have been harmed.

A key focus of the presentation was addressing the frequently cited defense that post-surgical infections are an “accepted risk” of surgery. Loren emphasized that while such risks may exist, they do not relieve healthcare providers of their obligation to exercise reasonable care or shield them from liability when preventable errors occur.

The session prompted thoughtful discussion among attendees and underscored the importance of holding providers accountable while advancing patient safety.
