Rouda Feder Tietjen & McGuinn Wins $58 Million Judgement on Behalf of Injured Worker

Rouda Feder Tietjen & McGuinn is pleased to announce the outstanding judgement we obtained on behalf of our client, 28-year-old Harley Squires, after he sustained a permanent, debilitating brain injury when a contractor dropped a 20-30 lb. tree limb on our client’s head from nearly 20-feet high. After a two-day bench trial, RFTM won over $58 million in damages for Harley’s injuries and the lifelong consequences of the contractor’s negligence. The judgement is recognized as the #1 Top Decision for Worker/Workplace Negligence in 2018. Attorneys Tim Tietjen and Robert Igleheart represented Mr. Squires.

On June 8, 2015, Harley was working for a contractor named Kruck. During the tree work, Kruck failed to check if it was safe and dropped a tree limb onto Harley and caused multiple skull fractures and bleeding in several areas of his brain. Harley immediately lost consciousness and would require complicated surgery removing a significant portion of his skull and implanting it in his stomach, until his skull could later be reconstructed. Unfortunately, Harley continues to have substantial cognitive deficits, seizures, debilitating headaches, and requires the use of a cane to walk. These new realities, as well as striking emotional and mental trauma, require 24/7 medical care and will affect Mr. Squires for the rest of his life.

The Court found that Kruck was negligent and caused Harley’s injuries. Of the over $58 million in damages, $40 million was for future pain and suffering. With this outstanding outcome, Rouda Feder Tietjen & McGuinn earned the award for #1 Top Decision for Worker/Workplace Negligence in 2018.

Kruck’s insurer denied coverage of our client’s damages on the basis that the incident was not covered under the insurance policy. Our client settled with the property homeowner for his policy limits of $1.5 million in negligently hiring Kruck as an unlicensed contractor. The case later went to a two day bench trial, where the outcome was determined following detailed testimony including 12 videotaped depositions and four expert witnesses.
